Yandaz aligns its internal enforcement mechanisms with the established legal framework of the Republic of Ghana, specifically the Copyright Act, 2005 (Act 690), the Trademarks Act, 2004 (Act 664), and the Patents Act, 2003 (Act 657). Beyond local legislation, Yandaz adopts international compliance standards aligned with WIPO (World Intellectual Property Organization) guidelines. We actively cooperate with brand owners to purge our marketplace of counterfeit, pirated, or unauthorized property.
If you are a rights holder or a legally authorized representative, and you identify content on Yandaz that violates your proprietary rights, you must file a formal **Notice of Infringement**. For your claim to be processed by our legal desk, it must be submitted in English and satisfy the following technical requirements:
For the unauthorized use of images, text, videos, or software:
For unauthorized use of logos, brand names, or slogans:
Upon receipt of a bona fide and legally complete Notification of Infringement, Yandaz will initiate the following enforcement actions:
To prevent "Takedown Abuse," Yandaz provides a robust Counter-Notice mechanism. If you believe your listing was removed due to a mistake or misidentification (e.g., you have a valid license or it is "Fair Use"), you may submit a Counter-Notice. This must include your contact info, identification of the material removed, a statement under penalty of perjury of your belief, and your consent to the jurisdiction of the Ghanaian courts should the rights holder choose to litigate.
Yandaz recognizes that complex IP disputes regarding Patents and Industrial Designs may require judicial determination. In such cases, Yandaz will remove content upon receipt of a court order or an official injunction from a Ghanaian court of competent jurisdiction. We encourage rights holders to engage in direct negotiation with sellers while keeping Yandaz informed of the legal progress.
LEGAL WARNING: Any individual or organization that knowingly misrepresents that a product or activity is infringing may be held liable for damages, including legal fees and costs incurred by Yandaz or the affected user. We take "bad faith" takedown requests seriously and will ban entities that abuse our IP reporting system.
